These Terms of Service ("Terms") form a binding agreement between you and Developer ("CrunchyWall", "we", "us"), the operator of the CrunchyWall website and service (the "Service"). By creating an account, browsing, downloading, or uploading any content through the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. If you are between 13 and that age, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed at children under 13, and we do not knowingly collect personal data from children under 13. If we learn that a child under 13 has provided us personal data, we will delete it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it up to date. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
You agree not to use the Service to upload, share, or transmit content that:
You also agree not to: scrape or bulk-download the Service outside features we provide for that purpose; attempt to gain unauthorized access to any account, system, or data; interfere with or disrupt the Service's infrastructure; bypass or attempt to bypass any access, rate-limiting, or authentication control; or use automated means (bots, scripts) to create accounts or interact with the Service without our written permission.
We reserve the right, but do not assume the obligation, to review, remove, or restrict access to any content that we believe, in good faith, violates these Terms or applicable law.
CrunchyWall allows approved creators ("Wallies") to upload wallpapers for other users to browse and download ("User Content"). This section explains how responsibility for that content is allocated between you and us.
By uploading any User Content, you represent and warrant that: (a) you own the content outright, or you hold all rights, licenses, consents, and permissions necessary to upload, display, and permit others to download that content through the Service; (b) the content does not infringe, misappropriate, or violate any third party's intellectual property, publicity, or privacy rights; and (c) the content complies with the Acceptable Use rules in Section 4.
CrunchyWall is a hosting platform for content submitted by its users. We do not, and cannot reasonably, verify the copyright ownership or licensing status of every file uploaded before it is published. CrunchyWall acts solely as an intermediary/host with respect to User Content and does not create, endorse, or vouch for the legality of any User Content unless expressly stated otherwise.
If we receive a valid, substantiated complaint (whether a DMCA-style takedown notice, a grievance under Indian law, or another legitimate legal claim) about a specific wallpaper, our response — absent a court order or law requiring broader action, and absent circumstances described in Section 5.4 below — is limited to removing or disabling access to that specific piece of content. We will not, solely on the basis of a single complaint against a single upload, delete a Wally's entire portfolio, disable their other uploads, or terminate their account.
This means: one wallpaper being taken down for a copyright or legal issue does not automatically mean any of that creator's other wallpapers are taken down, unless those other wallpapers are independently the subject of their own valid complaints, or the pattern described in Section 5.4 applies.
Notwithstanding Section 5.3, we reserve the right to suspend or terminate the account of any Wally who is the subject of repeated, substantiated claims of infringement (as a general guideline, though we may act sooner depending on severity), in accordance with applicable law, including 17 U.S.C. § 512(i) (the DMCA's repeat-infringer requirement) where applicable. This narrower, account-level remedy is reserved for genuine repeat offenders and is separate from the single-item removal described in Section 5.3, which remains our default response to an isolated complaint.
By uploading User Content, you grant CrunchyWall a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content through the Service for the purpose of operating and promoting CrunchyWall (including thumbnails, previews, and category/search listings), for as long as the content remains on the Service. You may request removal of your own content at any time via your account or by contacting us; we will remove it within a reasonable time, except where retention is required by law or for legitimate backup/record-keeping purposes for a limited period.
We may review, feature, categorize, or reject submissions at our discretion. We do not guarantee that any wallpaper will remain available indefinitely, and we may remove content that violates these Terms without prior notice.
The CrunchyWall name, logo, website design, and underlying software are the property of Developer and are protected by applicable intellectual property laws. Except for User Content (governed by Section 5) and content you download for personal use under a wallpaper's stated license, nothing in these Terms grants you any right to use CrunchyWall's trademarks, branding, or source code.
Unless a specific wallpaper states otherwise, downloaded wallpapers are provided for personal, non-commercial use (e.g., as a desktop or phone background). Redistributing, reselling, or using downloaded wallpapers commercially without the original creator's permission may infringe that creator's rights, and is done at your own risk and responsibility, not ours.
We respect the intellectual property rights of others and expect our users to do the same. If you believe content on CrunchyWall infringes your copyright, please send a written notice to our designated agent containing:
Send takedown notices to our designated DMCA agent at:

Action required before this is legally effective in the United States: to actually benefit from DMCA safe-harbor protection, the operator of CrunchyWall must register this agent with the U.S. Copyright Office at copyright.gov/dmca-directory (a small filing fee applies) and keep this page's contact details in sync with that registration.
Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the identified material, in accordance with Section 5.3 above. We will make a reasonable effort to notify the user who uploaded the content. If you believe your content was removed in error, you may submit a counter-notice with equivalent information; we may reinstate content in accordance with applicable law after a valid counter-notice, unless the original complainant files legal action.
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of our Grievance Officer are provided below. If you believe content on CrunchyWall violates applicable Indian law, or is defamatory, obscene, invasive of privacy, or otherwise unlawful, you may submit a complaint to:

Address: [ADDRESS IN INDIA]
The Grievance Officer will acknowledge your complaint within 24 hours and endeavor to resolve it within 15 days of receipt, as required by Rule 3(2) of the IT Rules, 2021. Content that a court or an appropriate government authority orders us to remove will be taken down within the statutorily prescribed period (currently 36 hours from receipt of such order).
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT USER CONTENT UPLOADED BY WALLIES IS ACCURATE, LAWFUL, OR NON-INFRINGING, AND WE DISCLAIM ANY RESPONSIBILITY FOR CONTENT WE DID NOT CREATE OURSELVES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRUNCHYWALL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY USER CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED INR 1,000 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or willful misconduct.
You agree to indemnify and hold harmless CrunchyWall, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your use of the Service; (b) User Content you upload; (c) your violation of these Terms; or (d) your violation of any third party's rights, including intellectual property or privacy rights.
We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason, including extended inactivity. You may stop using the Service and delete your account at any time. Sections of these Terms that by their nature should survive termination (including Sections 6, 9, 10, 11, and 15) will survive.
The Service relies on third-party infrastructure providers to operate, including but not limited to hosting, image storage/CDN, authentication (Google Sign-In), and transactional email delivery. Your use of features backed by these providers (for example, signing in with Google) is also subject to that provider's own terms and privacy policy. We are not responsible for the availability or conduct of third-party services.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where required by law, provide additional notice (such as an in-app notice or email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of [India / your state, e.g. "the Republic of India, without regard to conflict-of-laws principles"], without prejudice to any mandatory consumer-protection or data-protection rights you may have under the laws of your own country of residence. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of [CITY, STATE], India, or resolved by arbitration under the Arbitration and Conciliation Act, 1996, at the operator's election.
Questions about these Terms can be sent to [email protected].
